Canada: “One death is too many”, UNA

One is too many. This is the theme United Nurses of Alberta will be emphasizing on Sunday, April 28, 2019, the National Day of Mourning.

The National Day of Mourning has been observed on April 28 in Canada since 1991, a year after passage of the Workers Mourning Day Act by Parliament. It commemorates working people who have been killed, injured or suffered illness from workplace hazards and occupational exposures.

At UNA, we realize that health care is different from most occupations when it comes to protecting workers from the dangers of their work. This is because in addition to expected workplace hazards, nurses’ work requires a high degree of physical work with patients.

When people enter the health care system, they naturally experience fears and emotions, as do their friends and members of their families. Many of us feel we have lost control when we or a loved one is in a health care facility. This can lead to emotionally charged reactions and, sometimes, the potential for violence.

This helps explain why injuries to health care workers are so high compared to most other occupations. Health care workers’ lost-time claims and no-lost-time claims accepted by the Alberta Workers’ Compensation Board have been increasing. And all categories of injury – exposures, musculoskeletal injuries, slips, trips, falls, and workplace violence – increased in the health care sector between 2015 and 2017.

We know from analysis of 2017 Workers Compensation Board statistics that workers in the predominantly female health care sub-sector have the highest rate of accepted workplace violence claims. The WCB statistics indicate that health care workers are 70 times more likely to have an accepted WCB claim resulting from violence than the rate of violence-related claims in the predominantly male mining, manufacturing and construction sector.

So, what does One is to Many mean when there are so many injuries occurring?

Health care workers are now getting the message their injuries need to be reported. The increase in injury reporting has been shown through employer tracking systems. Only by reporting injuries can we as a workforce ensure changes in workplace practices occur that lower injury rates.

There has also been increase in reports to UNA of weapons use, violence and sexual assaults.

Meanwhile, research by the Canadian Federation of Nurses Unions sin 2017 suggested that 70 to 80 per cent of all violence faced by nurses is never reported. In a discussion paper entitled Enough is Enough, CFNU explained the higher risk of violence by pointing to short staffing, inappropriate placement of patients, inadequate security or inability to access security, lack of secure rooms for patients in emergency departments, lack of mental health beds at designated facilities, and inadequate communications protocols and practices.

At last year’s Day of Mourning ceremony in Edmonton, UNA, the Health Sciences Association of Alberta and the Alberta Union of Provincial Employees together called for an end to violence in health care. UNA President Heather Smith said security must be on site at every urgent care centre in Alberta.

Alberta Health Services has responded by hiring more security in some urgent care centres and placing more mobile security units in rural Alberta. This has led to more sites being able to access security assistance to deal with aggressive patients. Nevertheless, many areas remain that do not have access to timely security. More must be done to ensure safe workplaces for UNA’s members and other health care workers.

When one of our members is injured because the access to security is not timely, that is one too many.

Every time one of our members is injured because of faulty equipment, short staffing, or unsafe working conditions, that is one too many.

UNA calls on each of you to reflect on the dangers of your job on this Day of Mourning and remember you are an important person. UNA does not want you to be a statistic we mourn next year on April 28. When you go to work, work safe – your partner, your spouse, your children and family all want you to come home safe and uninjured.

APRIL 28TH Day of Mourning

Close to 1,000 workers in Canada die on the job every year.

Case after case shows that many of these deaths are preventable yet they still resulted in no Criminal Code charges, sometimes barely mustering a slap on the wrist or a fine that employers dismiss as the cost of doing business.

The law has been on the books since the United Steelworkers successfully lobbied to make the Westray Law a reality by making employer negligence contributing to a worker’s death or serious injury be treated as a criminal offence. But we have more work to do to make police, prosecutors and health and safety regulators aware and equipped to enforce it.

That is why we need to keep asking questions. Why are some police agencies willing to use the law while others are not? Why are health and safety agencies reluctant to work with police? Why are Crown attorneys avoiding prosecutions?  When asked if we are “looking to put every CEO in jail?” –  the answer is no. However, just like other criminal laws, we know the power of deterrence is critical to see the societal change necessary to keep our members and other workers alive.

We are starting to see progress being made with police protocols in British Columbia, Alberta, Nova Scotia, and Newfoundland- Labrador.  Today we have witnessed the successful prosecution of criminal charges filed under the Westray Law.  The work of USW activists and allies are making change a reality.

More charges are being laid across the country. More regulators and police are co-operating. Employers’ lawyers are warning them they too could face prosecution for failing to respect workers’ health and safety.

In British Columbia Premier John Horgan has pledged to ensure police and prosecutors have the resources they need to enforce the Westray Law.  We are making change. But, as long as too many employers are still getting away with fines, the fight has to continue.

Without pressure from USW members across Canada, we know that workplace deaths will not get the law enforcement attention they deserve and Crown prosecutors will continue to treat this as a regulatory issue and not a criminal one.

It’s far from perfect, and more work remains to be done, but Steelworkers can be proud that they have improved and saved the lives of working Canadians, union and non-union alike. Equally important, we have trained hundreds of health and safety activists who work every day to keep our members safe. We’ve trained even more to lobby and be politically active to ensure workers’ voices are heard by politicians of every stripe. Because if we don’t fight, who will?

We know every day that the laws that protect workers’ health and safety are meaningless unless they are enforced.   That is why we keep fighting.  So this April 28th yes we mourn for the dead, but we will rededicate ourselves to continue to fight for the living and keep our members safe on the job.

Canada: Rassemblement le 28 avril pour le Jour commémoratif des personnes décédées ou blessées au travail – Quebec

Parce que, chaque année, plus de 200 personnes meurent au travail ou à la suite d’un accident de travail, la FTQ invite ses syndicats affiliés à venir exprimer leur solidarité envers les familles des victimes en soulignant le Jour commémoratif des personnes décédées ou blessées au travail le 28 avril prochain.

Le 28 avril, vous êtes tous invités à venir nous rejoindre en face de l’Assemblée nationale à Québec à partir de 15 h afin de rappeler aux parlementaires leurs responsabilités par rapport à tous ces drames.

Parce que chaque vie compte et qu’un mort, c’est un mort de trop et qu’un accident de travail, c’est un accident de trop, Québec doit mieux protéger ses travailleurs et travailleuses.

Rappelons que la FTQ réclame depuis trop longtemps déjà que la Loi sur la santé et la sécurité du travail s’applique à tous les travailleurs et travailleuses du Québec. Encore aujourd’hui, plus de 80% des travailleuses et travailleurs sont exclus de l’application d’une grande partie de la loi et sont par le fait même victimes de discrimination, en raison du secteur économique et de leur métier.

The Canadian Labour Congress (CLC) has published a listing of the large number of International Workers’ Memorial Day events across Canada.

April 28 is the labour movement’s most solemn day. Every year, thousands of workers, friends and families of fallen workers gather at ceremonies across Canada to recognize the National Day of Mourning for workers killed or injured on the job. As we mourn for the dead, the Canadian Labour Congress continues to fight for the living.

Canada: CUPE – posters, flags, bookmarks and other resources. Day of Mourning

CUPE’S National Health and Safety Committee first proposed the creation of a national Day of Mourning in 1984.

That idea came to fruition in 1991 when the federal government passed legislation to establish April 28th as the Day of Mourning. It has grown internationally as the World Day for Safety and Health at Work and is recognized in more than 120 countries around the world.

When they envisioned the day, the members of the committee wanted to remember lives lost in the workplace. But there was a broader point. The day was also supposed to remind all workers that we need to fight for the living and inspire us to prevent further tragedies.

On each Day of Mourning, CUPE honours the members who died on the job.

Canada: TV advert runs to mark 28 April in Nova Scotia

NS Federation of LabourThe Nova Scotia Federation of Labour – in partnership with the Workers’ Compensation Board of Nova Scotia, Threads of Life  and  Nova Scotia province – has produced a television advert  to mark the 28 April International Day of Mourning (featured below) . The Federation observed that “In 2018 there were 16 deaths in workplaces and several others died because of a workplace illness or disease.
