(at least in compassion.)<\/p>\n<p>Workers Memorial Day, for those just tuning in, is an annual event to remember those killed in the workplace and re-energize ourselves to fight for safer work. Or, as Mother Jones said, \u201cPray for the dead, and fight like hell for the living.\u201d<\/p>\n<p>So, as I catch up, I figured I\u2019d include you in my catching-up activities \u2014 and feel free to leave any of your Workers Memorial Day experiences in the comments below.<\/p>\n<p><b>Death on the Job<\/b><\/p>\n<p><a href=\"https:\/\/28april.org\/wp-content\/uploads\/2026\/05\/download-1.png\"><img loading=\"lazy\" class=\"alignleft wp-image-8245 size-thumbnail\" src=\"https:\/\/28april.org\/wp-content\/uploads\/2026\/05\/download-1-150x150.png\" alt=\"\" width=\"150\" height=\"150\" \/><\/a><\/p>\n<p>The highlight of this season is always the annual issuance of the AFL-CIO\u2019s \u201c<a title=\"https:\/\/aflcio.org\/dotj-2026\" href=\"https:\/\/aflcio.org\/dotj-2026\" data-auth=\"NotApplicable\" data-linkindex=\"2\">Death on the Job<\/a>,\u201d now in its 35th edition. DOTJ is the bible of the occupational safety and health environment in the United States, an enormously detailed work containing not only a summary of the political environment that workplace safety and health finds itself in, but also injury and illness data in much more detail and clarity than the Bureau of Labor Statistics releases. Also current and historical budget and staffing information and what that means for workers. (For example, that it now takes 191 years for federal OSHA to visit each workplace in the country just once.)<\/p>\n<p>And all of the information is available by state, e.g. injury, illness and death rates, number of inspectors, average and median penalties penalties, and how the states rank. You can find the summary points\u00a0<a title=\"https:\/\/aflcio.org\/dotj-2026\" href=\"https:\/\/aflcio.org\/dotj-2026\" data-auth=\"NotApplicable\" data-linkindex=\"3\">here<\/a>\u00a0and download the entire document\u00a0<a title=\"https:\/\/aflcio.org\/sites\/default\/files\/2026-04\/485%20DOTJ_2026%20FIN-NBUG%20rev.pdf\" href=\"https:\/\/aflcio.org\/sites\/default\/files\/2026-04\/485%20DOTJ_2026%20FIN-NBUG%20rev.pdf\" data-auth=\"NotApplicable\" data-linkindex=\"4\">here<\/a>\u00a0and you will mountains of information at your fingertips for any future meetings with journalists, legislators or that obnoxious MAGA uncle at Thanksgiving.<\/p>\n<p>In summary, as the report documents:<\/p>\n<p>Over the last 35 years of this report, job safety agencies\u2019 resources have diminished dramatically, even as their responsibilities have grown immensely. For instance, the Occupational Safety and Health Administration is now in charge of 85% more establishments, 44% more workers and new hazards and technologies, yet Congress has reduced its budget by 10% and staffing by 26%, including a 16% reduction in inspectors. These percentages have massive impacts on such a tiny agency and very real personal effects on workers and their families. Agencies now have a paltry number of staff to write standards, analyze data, conduct inspections, perform oversight on states, orchestrate needed research on important hazards and respond to emerging threats. The number of OSHA inspectors has now hit a new low, and the Mine Safety and Health Administration (MSHA) does not have enough inspectors to meet its statutory requirement to inspect each mine multiple times a year.<\/p>\n<p>And why?<\/p>\n<p>Corporate power has eroded worker protections for years, but under the Trump administration, corporations and billionaires are aggressively accelerating efforts to dismantle hard-won progress and the democratic institutions that uphold it. These structures have safeguarded workers from employers who prioritize excessive profit over effective safety measures, resist workers\u2019 rights and protections and seek to shift the responsibility for providing safe jobs from employers onto individual workers.<\/p>\n<p>You can find\u00a0<a title=\"https:\/\/aflcio.org\/dotj-2026#:~:text=The%20Trump%20administration%20has%3A%C2%A0\" href=\"https:\/\/aflcio.org\/dotj-2026#:~:text=The%20Trump%20administration%20has%3A%C2%A0\" data-auth=\"NotApplicable\" data-linkindex=\"5\">specifics<\/a>\u00a0on the Trump Administration, OSHA\u00a0<a title=\"https:\/\/aflcio.org\/dotj-2026#:~:text=the%20regulatory%20process.-,OSHA%20resources,-in%20FY%202025\" href=\"https:\/\/aflcio.org\/dotj-2026#:~:text=the%20regulatory%20process.-,OSHA%20resources,-in%20FY%202025\" data-auth=\"NotApplicable\" data-linkindex=\"6\">resources<\/a>, and action needed\u00a0<a title=\"https:\/\/aflcio.org\/dotj-2026#:~:text=Action%20needed%20from%20Congress\" href=\"https:\/\/aflcio.org\/dotj-2026#:~:text=Action%20needed%20from%20Congress\" data-auth=\"NotApplicable\" data-linkindex=\"7\">from Congress<\/a>\u00a0and\u00a0<a title=\"https:\/\/aflcio.org\/dotj-2026#:~:text=Action%20needed%20from-,job%20safety%20agencies,-%3A\" href=\"https:\/\/aflcio.org\/dotj-2026#:~:text=Action%20needed%20from-,job%20safety%20agencies,-%3A\" data-auth=\"NotApplicable\" data-linkindex=\"8\">job safety agencies<\/a>.<\/p>\n<p>And there\u2019s plenty of ammunition for your next OSHA Trivia party. Who was the (Acting) Assistant Secretary?<\/li>\n<li>What percentage of all serious work-related injuries and illnesses in private industry do musculoskeletal disorders from repetitive motion injuries accounting for?<br \/>\n(see below for answers)<\/li>\n<\/ol>\n<p><b>Unions and Others<\/b><\/p>\n<p><a href=\"https:\/\/28april.org\/wp-content\/uploads\/2026\/05\/download-2.png\"><img loading=\"lazy\" class=\"size-full wp-image-8246 alignnone\" src=\"https:\/\/28april.org\/wp-content\/uploads\/2026\/05\/download-2.png\" alt=\"\" width=\"453\" height=\"462\" srcset=\"https:\/\/28april.org\/wp-content\/uploads\/2026\/05\/download-2.png 453w, https:\/\/28april.org\/wp-content\/uploads\/2026\/05\/download-2-294x300.png 294w\" sizes=\"(max-width: 453px) 100vw, 453px\" \/><\/a><\/p>\n<p>Workers Memorial Day is an international event, with hundreds of local events across the country conducted by unions, COSH groups and families of those killed or injured in the workplace. Throughout this country and around the world,\u00a0 rallies, marches, protests, concerts, picnics, festivals, trainings and town halls were held with community and movement partners to support thousands more local events.\u00a0 A partial list of worldwide events and graphics can be found\u00a0<a title=\"https:\/\/28april.org\/?cat=2110\" href=\"https:\/\/28april.org\/?cat=2110\" data-auth=\"NotApplicable\" data-linkindex=\"9\">here<\/a>.<\/p>\n<p><b>Dirty Dozen<\/b><\/p>\n<p>Accompanying the annual release of the AFL-CIO\u2019s Death on the Job is the National COSH\u2019s\u00a0<a title=\"https:\/\/nationalcosh.org\/Dirty_Dozen\" href=\"https:\/\/nationalcosh.org\/Dirty_Dozen\" data-auth=\"NotApplicable\" data-linkindex=\"10\">Dirty Dozen report<\/a>\u00a0which you can download\u00a0<a title=\"https:\/\/nationalcosh.org\/resources\/dirty-dozen-2026\" href=\"https:\/\/nationalcosh.org\/resources\/dirty-dozen-2026\" data-auth=\"NotApplicable\" data-linkindex=\"11\">here<\/a>. The Dirty Dozen report is \u201ca list that shines a spotlight on twelve employers that have failed to protect their workers from preventable injuries, illnesses, and deaths.\u201d\u00a0 They were chosen due to<\/p>\n<ul type=\"disc\">\n<li>Repeated and serious violations of workplace safety laws<\/li>\n<li>A history of ignoring known hazards<\/li>\n<li>Power to set harmful industry standards<\/li>\n<li>Active campaigns by workers and allies demanding change<\/li>\n<\/ul>\n<p>This year\u2019s lucky winners were:<\/p>\n<ul type=\"disc\">\n<li><b>Alliance Ground International<\/b>: Repeated safety violations, unsafe equipment, and worker mistreatment allegations.<\/li>\n<li><b>Cambria Company, LLC<\/b>: Engineered stone products linked to deadly silica disease.<\/li>\n<li><b>CommonSpirit Health<\/b>: Unsafe staffing, workplace violence, and labor concerns impacting care.<\/li>\n<li><b>Consolidated Catfish Producers, LLC<\/b>: Amputations, machine hazards, and dangerous indoor heat.<\/li>\n<li><b>D.R. Horton, Inc.<\/b>: Repeated safety violations and hazardous construction jobsite conditions amid ICE enforcement actions.<\/li>\n<li><b>Hyundai-Kia U.S. Supply Chain<\/b>: Worker deaths, child labor findings, and subcontracted exploitation.<\/li>\n<li><b>Jeny Sod and Nursery<\/b>: Wage theft claims, heat risks, pesticide exposure, and housing concerns.<\/li>\n<li><b>LSG Sky Chefs<\/b>: Extreme heat and lack of cooling protections for workers.<\/li>\n<li><b>Maker\u2019s Pride LLC (formerly Hearthside, LLC)<\/b>: Amputations, child labor violations, and anti-union concerns.<\/li>\n<li><b>Revoli Construction Co., Inc<\/b>: Decades of trenching violations ending in fatal collapse.<\/li>\n<li><b>Subway IP LLC<\/b>: Wage theft, retaliation, and labor issues across franchises.<\/li>\n<li><b>Wellmade Industries MFR. N.A LLC<\/b>: safety violations, labor exploitation, and trafficking investigation.<\/li>\n<\/ul>\n<p>Some of these you\u2019ve never heard of; some you will live in infamy. We\u2019ve written about some of these before, for example Cambria, the artificial countertop company whose product is killing workers due to silica exposure and their efforts to convince Congress to shield them from lawsuits.<\/p>\n<p><b>Department of Labor Events<\/b><b><\/b><\/p>\n<p><a href=\"https:\/\/28april.org\/wp-content\/uploads\/2026\/05\/download-3.png\"><img loading=\"lazy\" class=\"size-full wp-image-8247 alignnone\" src=\"https:\/\/28april.org\/wp-content\/uploads\/2026\/05\/download-3.png\" alt=\"\" width=\"720\" height=\"1024\" srcset=\"https:\/\/28april.org\/wp-content\/uploads\/2026\/05\/download-3.png 720w, https:\/\/28april.org\/wp-content\/uploads\/2026\/05\/download-3-211x300.png 211w\" sizes=\"(max-width: 720px) 100vw, 720px\" \/><\/a><\/p>\n<p>The Department of Labor this year held one of the biggest\u00a0<a title=\"https:\/\/www.osha.gov\/workers-memorial-day\" href=\"https:\/\/www.osha.gov\/workers-memorial-day\" data-auth=\"NotApplicable\" data-linkindex=\"12\">Workers Memorial Day events<\/a>\u00a0ever, with panel discussions, a tear-inducing\u00a0<a title=\"https:\/\/youtu.be\/SaLiXH5d4FY?si=8y_d7uQd6f2OyP5l\" href=\"https:\/\/youtu.be\/SaLiXH5d4FY?si=8y_d7uQd6f2OyP5l\" data-auth=\"NotApplicable\" data-linkindex=\"13\">video<\/a>\u00a0of family members, a\u00a0<a title=\"https:\/\/www.youtube.com\/watch?v=tTnEQn4rnbY\" href=\"https:\/\/www.youtube.com\/watch?v=tTnEQn4rnbY\" data-auth=\"NotApplicable\" data-linkindex=\"14\">panel discussion<\/a>\u00a0by family members, a candlelight ceremony at the Lincoln Memorial and a three day virtual training on fall prevention, trenching and lockout-tagout.\u00a0 The program at the Department of Labor also featured two Republican Congressmen one of whom was Ryan McKenzie (R-PA), Chair of the House Workforce Protections subcommittee who frequently criticizes OSHA for overstepping its authority and accuses OSHA standards for creating more problems than they solve.<\/p>\n<p>Pennsylvania Representative Dan Meuser also spoke at the event about the farmers he meets who \u201care missing a finger or two; some are missing arms.\u201d But no mention of how farm workers are not covered by most OSHA standards and how Congress prohibits OSHA from setting foot on small farms even after workers are killed.<\/p>\n<p>The OSHA effort is praiseworthy. I have heaped a lot of well-deserved criticism on Trump\u2019s OSHA over the past year, but one area where they deserve praise is the continued employment of a one of my favorite people, OSHA Family Liaison Tonya Ford, and the Workers Memorial Day events they continue to support. Tonya lost her uncle Bobby in a fall in a grain elevator and was later the Executive Director of\u00a0<a title=\"https:\/\/www.usmwf.org\/\" href=\"https:\/\/www.usmwf.org\/\" data-auth=\"NotApplicable\" data-linkindex=\"15\">United Support and Memorial for Workplace Families<\/a>, an organization dedicated to the family members of workers killed in the workplace.<\/p>\n<p>But I also have mixed feelings about the DOL event.\u00a0 Last year, Workers Memorial Day came only days after DOGE\u2019s invasion of DOL and the near elimination of NIOSH and I couldn\u2019t bring myself to attend.<\/p>\n<p><b>My problem is DOL they did a very good \u2014 and necessary \u2014 job of recognizing the indescribably sorrow and loss that a preventable workplace death inflicts on the worker\u2019s family, friends and co-workers. But that\u2019s the\u00a0<i>mourning<\/i>\u00a0part of Workers Memorial Day. What was missing from these events were the \u201cfight like hell for the living\u201d part.<\/b><\/p>\n<p>My problem is that DOL did a very good \u2014 and necessary \u2014 job of recognizing the indescribably sorrow and loss that a preventable workplace death inflicts on the worker\u2019s family, friends and co-workers. That\u2019s important.\u00a0 And, again, I complement the agency for holding this event and giving such an important role to the grieving families.<\/p>\n<p>But that\u2019s only the\u00a0<i>mourning<\/i>\u00a0part of Workers Memorial Day. What\u2019s missing from these events were the \u201cfight like hell for the living\u201d part.<\/p>\n<p>There was no recognition of the merciless attacks on NIOSH or the drastic cuts to OSHA and MSHA proposed this year and last by the White House or the fact that OSHA now has the lowest number of inspectors in the agency\u2019s history or the fact that the Trump regime has refused to enforce MSHA\u2019s silica standard or the general hostile anti-worker political environment detailed so well in the AFL-CIO\u2019s\u00a0<i>Death on the Job<\/i>.<\/p>\n<p>The only \u201csolution\u201d that comes out of this event \u2014 at least on the surface \u2014 is not fighting for more funding for workplace protection agencies, higher penalties for endangering workers and stronger standards; it\u2019s mainly variations on \u201cshit happens,\u201d so \u201clet\u2019s be careful out there,\u201d without any recognition of the evisceration of this country\u2019s workplace safety and health infrastructure by the Administration that is staging this event.<\/p>\n<p>OSHA Assistant Secretary Dave Keeling correctly stated that we need to \u201cdo all we can to work together to put the the safety and health of our workers first. At the end of the day, a safe workplace is not a privilege, it\u2019s a promise that we owe one another.\u201d<\/p>\n<p>Nice words, but cutting the budgets of OSHA and MSHA, destroying NIOSH and eliminating the Chemical Safety Board are not the way to keep that promise.<\/p>\n<p>MSHA Assistant Secretary Wayne Palmer remembered several workers by name who were killed on the job, but somehow failed to mention MSHA\u2019s failure to enforce its silica standard.<\/p>\n<p>About the closest it came to calling for action came from Stacy Sebald whose 19-year-old son, Mitchell, was killed in a grain auger \u2014 on a small farm that wasn\u2019t covered by OSHA. Stacy has been on a\u00a0<a title=\"https:\/\/www.sheboyganpress.com\/story\/news\/local\/2024\/08\/21\/stacy-sebald-pushing-for-osha-law-change-that-prevented-investigation-into-sons-death\/74875043007\/\" href=\"https:\/\/www.sheboyganpress.com\/story\/news\/local\/2024\/08\/21\/stacy-sebald-pushing-for-osha-law-change-that-prevented-investigation-into-sons-death\/74875043007\/\" data-auth=\"NotApplicable\" data-linkindex=\"16\">campaign<\/a>\u00a0to eliminate that language: \u201cI will not be at peace with that exemption.\u201d<\/p>\n<p>None of us should be at peace with what\u2019s going on in this country and how this administration has treated workers.\u00a0 We need to keep fighting like hell.<\/p>\n<p>But let\u2019s not be too depressed.
